ARBITRATION NOTICE: THE GENERAL DISNEY PINNACLE BY DAPPER LABS TERMS OF USE SET FORTH HERE (THE “GENERAL TERMS”) CONTAIN AN ARBITRATION PROVISION (SEE SECTION 16 OF THE GENERAL TERMS). PLEASE REVIEW THE ARBITRATION PROVISION CAREFULLY, SINCE IT AFFECTS YOUR RIGHTS. BY USING THE DISNEY PINNACLE BY DAPPER LABS APPLICATION (THE “APP”), OR ANY PART OF IT, INCLUDING YOUR ENTRY AND PARTICIPATION IN THIS Promotion, YOU UNDERSTAND AND AGREE TO BE BOUND BY THE ARBITRATION PROVISION IN THE GENERAL TERMS.
The Disney+ Perks Program Offering Promotion (the “Promotion”) starts on [May 29th, 2025 at 10:00AM PDT and ends on June 26th, 2025 at 9:59:59AM PDT] (the “Promotion Period”). The Promotional Period will reset on the 4th Thursday of every month until May 29th, 2026.
ELIGIBILITY: The Promotion is open to Disney+ Subscribers (“DPS”), who are defined as individuals that are legal residents (natural persons only) and physically located in one (1) of the fifty (50) United States or the District of Columbia, who are eighteen (18) years of age or older (or of the legal age of majority in their state or province of residence, whichever is older) at the time of entry. Void where prohibited by law. The Promotion is subject to all applicable United States and federal, state and local laws.
PIN OF THE MONTH: Each month, Disney+ subscribers will be eligible to receive a maximum of one (1) Disney Pinnacle by Dapper Labs Pin1 (the “Reward”) by logging into their Disney Pinnacle by Dapper Labs account and redeeming the monthly promotional code found in their Disney+ Perks offer. The Reward will be delivered to the user’s Disney Pinnacle by Dapper Labs account within 30 days after entering the Promotion. For the first month only, the Reward will also include $10 in Disney Pinnacle by Dapper Labs credit. This credit may not be exchanged, redeemed, or withdrawn for USD or real currency. Entrants agree and acknowledge that they are required to verify their identity in order to claim the Reward and $10 in Dapper Labs Credit.
This offer may only be redeemed by the original Disney+ subscriber recipient of the promotional code to whom this e-mail was sent, for personal, non-commercial use only, and it cannot be shared with any other person or transferred in exchange for money or any other consideration.
Any attempt to sell or otherwise transfer the promotion code will result in such promotion being revoked and the individual attempting to sell or otherwise transfer forfeiting their participation in such promotion.
GENERAL: ENTRANTS ACKNOWLEDGE AND AGREE BY PARTICIPATING IN THE Promotion THAT THEY MAY BE WAIVING CERTAIN LEGAL RIGHTS THAT THEY MAY OTHERWISE HAVE. By participating in the Promotion, each entrant agrees: (a) to abide by these Official Rules and decisions of Dapper Labs, Inc., Disney Pinnacle by Dapper Labs Terms of Use, Dapper Service Terms of Use, and the decisions of the Dapper Labs, Inc., which shall be final and binding in all respects relating to this Promotion; and (b) to release, indemnify, discharge and hold harmless Dapper Labs, Inc., Disney Streaming Services, LLC, and its and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from and against any and all costs, claims, damages, (including, without limitation, any special, incidental, or consequential damages), or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Promotion, or arising out of participation in any Promotion related or Reward related Activity, or the receipt, enjoyment, participation in, use or misuse, of any Promotion or Reward related activity, whether hosted by Dapper Labs, Inc. or a Third Party. By participating, entrants also agree not to release any publicity or other materials on their own or through someone else regarding their participation in the Promotion without the prior consent of the Dapper Labs, Inc., which it may withhold in its sole discretion. The Released Parties are not responsible for any delay or failure to receive notification from Dapper Labs, Inc., or for Dapper Labs, Inc. to fail to receive a potential winner’s response, for any reason, including inactive account(s), technical difficulties associated therewith, or a potential Reward Winner’s failure to adequately monitor any account. The Released Parties are not responsible for communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in an entrant’s email account to receive email messages. The Released Parties are not responsible for false, incorrect, changed, incomplete or illegible contact information
Rewards are awarded “as is” with no warranty or guarantee, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdiction may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties so some of the limitations or exclusions contained herein may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions. Reward winners may not substitute, assign or transfer their Reward, but we reserve the right, at Dapper Labs, Inc.’s sole discretion, to substitute the Reward with another Reward of comparable or greater value. The Reward recipients are responsible for all applicable federal, provincial, state and local taxes, if any, as well as any other costs and expenses otherwise associated with accepting any Reward. All Reward details are provided at Dapper Labs, Inc.’s sole discretion. Dapper Labs, Inc. will not be required to award more Rewards than the number of available Rewards set forth in these Official Rules. Each eligible person can receive a maximum of (1) one Reward. If an Entrant is found to have entered the Promotion more than once or via more than one account (or multiple times from the same account), or has any other methods in an attempt to receive more than the permitted maximum entries, that Entrant will receive one (1) entry into the Promotion and all additional entries submitted by the Entrant will be removed from the total number of eligible entries. All Reward awards are subject to identity verification and verification of eligibility and compliance with these Official Rules.
In no event will the Released Parties be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and participating in the Promotion and/or downloading from and/or print material downloaded from any website associated with the Promotion. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing or judging of the Promotion, the selection of potential Reward winners, or the announcement of any Reward. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by other entrants or site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Promotion or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Dapper Labs, Inc., will be disqualified. Should any portion, or the entirety of the Promotion be deemed illegal in any jurisdiction in the United States, Dapper Labs, Inc. reserves the right at its sole discretion to suspend, modify or terminate the Promotion. Should any portion of the Promotion be, in Dapper Labs, Inc.’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Dapper Labs, Inc., corrupt or impair the administration, security, fairness or proper play, or submission of entries, Dapper Labs, Inc. reserves the right at its sole discretion to suspend, modify or terminate the Promotion and, if terminated, at its discretion, select the potential winner(s) from all eligible participants using the procedures outlined above. CAUTION: ANY ATTEMPT TO DAMAGE THE DISNEY PINNACLE BY DAPPER LABS SITE OR APP OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE Promotion MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, DAPPER LABS, INC. RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
GOVERNING LAW: The Promotion shall be governed by and construed in accordance with the laws of the state of California and the federal laws of United States applicable therein without giving effect to any choice or conflict of law provision or rule. (whether of the state of California or any other jurisdiction).
DISNEY AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, SHAREHOLDERS, OFFICERS, DIRECTORS, AGENTS, MEMBERS, REPRESENTATIVES, AND EMPLOYEES ARE NOT SPONSORS OF THIS PROMOTION AND WILL HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY CLAIM ARISING IN CONNECTION WITH PARTICIPATION IN THIS PROMOTION OR ANY REWARD AWARDED. DISNEY HAS NOT OFFERED OR SPONSORED THIS PROMOTION IN ANY WAY.
